The Supreme Court of the United States eliminates the MPP: People no longer have to stay outside the country to request asylum

Jul 19, 2022 | Immigration News, immigration lawyer

Good news for United States immigrants affected by the Migrant Protection Protocols (MPP) also known as “remain in Mexico.” On Tuesday, June 30th, 2022, the Supreme Court ruled in favor of eliminating the MPP. This means that people will no longer have to stay in out of the country while they wait for their asylum hearing. This is a huge victory for immigrants and their families, and it will help to keep them safe while they are waiting for their hearing. At Puntier Law, we applaud the Supreme Court’s decision and we encourage all immigrants who are eligible to apply for asylum to do so as soon as possible!

The MPP is a reminder that immigration laws can change at any moment

The MPP was put in place by the Trump Administration in 2019 in order to deter immigration and to make it more difficult for people to obtain status in the United States. The MPP required that people who were seeking asylum stay out of the country while they waited for their hearing. This put them at risk of violence, exploitation, and disease. It also separated families, as some members would have to stay in Mexico while others waited in the United States.

There are many in favor of stricter immigration policies in the United States

The Biden administration put an end to the MPP in 2021, but the decision was appealed by anti-immigration groups. Recently the Supreme Court ruled in favor of eliminating the MPP despite the appeal. While this is a victory for immigrants and their families it is important to note that many are still in favor of stricter policies that do not favor immigrants. Immigration laws can change at any moment, so it is important to stay up-to-date on the latest news and to consult with an immigration attorney to adjust your status as soon as possible.

Title 42 can affect people seeking safety at the United States Border

Immigrants seeking safety at the border may be blocked from applying for asylum because Title 42 is still in place. Title 42 is a public health order that was put in place in 2020 in response to the COVID-19 pandemic. It allows the United States government to turn away people at the border who they deem to be a public health risk. This order has been used to block many people, including asylum seekers, from entering the United States. So despite the elimination of MPP, some immigrants may need help from an attorney navigating other obstacles like this to reenter the United States.

Apply for asylum with the help of an attorney

You can apply for asylum directly with USCIS or you can go through an immigration attorney. The immigration process is complicated and it can be difficult to navigate on your own. An immigration attorney will be able to help you with the paperwork and ensure that everything is filed correctly. They can also represent you in court if necessary. This is especially important in the event that immigration laws change in the middle of your process or if the department of homeland security surprises you with compromising allegations that can hurt your case.

There are many pathways to residency and citizenship

There are many ways to get a green card and adjust your status in the United States. Even if you think you may not qualify for any immigration benefits, you should consult with an attorney who can help you explore creative possibilities you may not have considered. If you or someone you know is seeking asylum, contact Puntier Law today! We would be happy to help you with your case and answer any questions that you may have.
